“WIN WITH SHARK NINJA AT SYDNEY RUNNING FESTIVAL 2025” TERMS AND CONDITIONS

  1. Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Entry is only open to Australian residents.
  3. Entrants under 18 years of age must have permission from a parent or guardian who is over 18 years of age. Parents or guardians must consent to the entrant’s participation in the promotion and agree to these Terms and Conditions on their behalf. Documentation of this consent may be required.
  4. Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to participate. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
  5. Entries into the promotion open and close during the below dates for each Activation (defined below in clause 6):
    • Activation 1 (Running Expo): commencing at 9:00am AEST on 28/08/2025 and closing at 4:00pm AEST on 31/08/2025; and
    • Activation 2 (Running Festival): commencing at 7:00am AEST on 30/08/2025 and closing at 4:00pm AEST on 31/08/2025.
    (Collectively referred to as “Promotional Period”).
  6. To enter, individuals must, during the relevant dates for each Activation as per clause 5, undertake the following steps:
    1. Activation 1 (Running Expo):
      • Visit the activation site for the Running Expo at the ICC Sydney;
      • Scan the promotional QR code available on site;
      • Follow the prompts to the online entry form, input the requested details (including name, email, phone and state) and submit the fully completed online entry form;
      • Entrants must then show the online submission confirmation page to staff at the Activation site for the opportunity to play the “Ninja Prize Box” game which involves receiving an SMS with a code and entering that unique code into an iPad provided at the activation site; and
      • Once the individual completes the game, they will be immediately notified if they have won an instant prize.

    2. Activation 2 (Running Festival):
      • Visit the activation site for the Running Festival at the Royal Botanic Gardens Sydney;
      • Follow the prompts to the online entry form, input the requested details (including name, email, phone, state and country) and submit the fully completed online entry form;
      • Entrants must then show the online submission confirmation page to staff at the Activation site for the opportunity to play the “Shark Ninja Power Spin!” game which involves entrants spinning a manual spinning wheel at the activation site to reveal whether they have won an instant prize; and
      • Once the individual completes the game, they will be immediately notified if they have won an instant prize as listed in clause 13(d) or whether they have received a bonus entry into the draw for the Major Prize.
  7. The activation site will be accessible during each Activation period outlined in clause 5 and only while manned by staff members. Individuals must complete a game at either Activation in accordance with the staff member’s instructions, for the chance to win an instant prize, subject to the availability of instant prizes. Instant win prizes will be awarded to winning entrants on the spot excluding the optional prizes (Ninja Blast Max, Shark SmoothStyle, Shark WandVac and Shark HydroGo) the instant prize for Activation 2 as which these will be delivered to winners at their nominated postal address.
  8. Individuals that participate in an Activation, as per the above, will be awarded one (1) entry into the major draw.
  9. Multiple entries permitted subject to the following:
    1. Only one (1) attempt is permitted at each Activations’ game per day. For the avoidance of doubt, individuals can participate in both Activations in a single day for a total maximum of two (2) attempts that day;
    2. Only one (1) initial entry into the draw permitted per attempt; and
    3. Only one (1) bonus entry is permitted per person subject to the each time an individual’s attempt at the “Shark Ninja Power Spin!” game in Activation 2 resultsing in a bonus entry; and
  10. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.
  11. Incomplete or indecipherable entries will be deemed invalid.
  12. If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant.
  13. There is a total of one thousand, six-hundred and fifty (1,650) instant win prizes available to be won during the Promotional Period across both Activations (see below).
    1. The instant win prizes that are available to be won at Activation 1 (Running Expo): include:

    2. The instant win Shark Ninja prizes that are available to be won at Activation 2 (Running Festival) include:
      • Choice of one (1) of the following 200 x Shark Ninja Instant Winprizes, subject to availability valued at $200;
        • 100x Ninja Blast Max valued at $129.99
        • 40x Shark SmoothStyle valued at $149.99
        • 40x Shark WandVac valued at $199.99

        • 400 x Shark Ninja $100 voucher; and 400 x Shark Ninja $50 voucher. ; and
  14. The draw for the Major Prize will take place at Handling Matters, Unit 40, 1-5 Thew Parade Cromer NSW 2099 on 02/09/2025 at 11:00am AEST. The Promoter may draw additional reserve entries and record them in order in case an invalid entry or ineligible entrant is drawn. The winner of the Major Prize will be notified by email and telephone within seven (7) days of the draw.
  15. The Promoter’s decision is final and no correspondence will be entered into.

  17. Any ancillary costs associated with redeeming the Shark Ninja voucher or discount code are not included. Any unused balance of the Shark Ninja voucher or discount code will not be awarded as cash. Redemption of the Shark Ninja voucher or discount code is subject to any terms and conditions of the issuer including those specified on the Shark Ninja voucher or discount code.
  18. Winners are responsible for ensuring that all prize delivery details provided are correct. The Promoter will not be liable for any costs associated with re-delivery of a prize, should the delivery details provided by a winner be incorrect.
  19. Subject to the unclaimed prize draw clause, if for any reason a winner does not take a prize (or an element of the prize) by the time stipulated by the Promoter, then the prize (or that element of that prize) will be forfeited.
  20. If any prize (or any part of a prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value or specification, subject to any written directions from a regulatory authority.
  21. Total prize pool value is up to $117,009.8214,5,501.32.
  22. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise specified.
  23. If a winner of any prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on the winner’s behalf.
  24. A draw for any unclaimed prizes may take place on 02/10/2025 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winners, if any, will be notified by email and phone within seven (7) days of the draw.
  25. In the event of war, terrorism, state of emergency, government lockdown, pandemic or any other kind of disaster or unforeseeable event beyond the Promoter’s reasonable control, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority.
  26. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  27. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law: (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
  28. Quality control errors will not invalidate an otherwise valid prize claim. Unless otherwise due to fraud or ineligibility under these Terms and Conditions, all prize claims in excess of the advertised prize pool will be honoured. Any instant win prizes that are part of the advertised total prize pool that are won but remain unclaimed will be awarded in the unclaimed prize draw.
  29. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  30. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking of a prize.
  31. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed here. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter. The Promoter will not disclose PI to any entity outside of Australia.
